Terms and Conditions for AIRFIBR Internet Installation Services
Effective Date: This Agreement is effective upon the completion of the installation of the necessary devices and receipt of payment for installation fees. The Subscriber’s acceptance of this Agreement confirms the Subscriber’s understanding of the terms outlined herein. The Agreement will remain in force until terminated by either party.
1. Service Term
The service term begins on the Service Commencement Date, which is the day the service is activated, and continues on a month-to-month basis unless terminated by either party. Either party can terminate this Agreement with written notice in accordance with the termination provisions. AIRFIBR reserves the right to modify service fees at any time, with prior notice provided to the Subscriber.
2. Installation and Equipment
AIRFIBR will provide the necessary equipment for the installation of the Optical Network Unit (ONU) and peripherals. The equipment remains the property of AIRFIBR at all times, and the Subscriber agrees to return the equipment upon termination of service. Any damages to the equipment, except for those caused by factory defects, will be the responsibility of the Subscriber.
3. Service Activation
The service is activated after testing, and the first billing will be prorated for the period from the activation date to the next billing cycle. The Subscriber will receive an electronic Statement of Account (SOA) via email, and only reminders or announcements will be sent via SMS. It is the Subscriber’s responsibility to ensure that the correct email address is provided and kept up to date.
4. Billing and Payment
The Subscriber agrees to pay the Monthly Service Fee by the 5th of each month. Payments made after the 5th may result in service suspension until full payment is made. The Subscriber agrees to notify AIRFIBR of any discrepancies in their Statement of Account within 15 days, after which the statement will be considered accurate.
5. Service Use
The service is provided only for the intended purpose as applied for. Misuse of the service may result in immediate disconnection without prior notice. Any breach of the intended use, including illegal activities, is subject to disconnection and forfeiture of any paid amounts.
6. Force Majeure
AIRFIBR is not responsible for service interruptions caused by factors beyond its control, such as acts of God, network failures, or labor disputes. In the event of such occurrences, AIRFIBR will take reasonable steps to restore service as soon as possible, but will not be held liable for any loss or damage caused by the disruption.
7. Transfer of Service
The service cannot be transferred to another person or location without prior written consent from AIRFIBR. Unauthorized transfers or changes in ownership or location of the service will result in immediate disconnection. AIRFIBR reserves the right to charge a transfer fee for any approved transfers.
8. Relocation
Subscribers moving to a new address within the service area may apply for relocation. A relocation fee will apply to cover the cost of dismantling and reinstalling the equipment at the new location. If the new location is outside the service area, the subscription will be terminated, and the Subscriber will be liable for any outstanding charges.
9. Changes to Service
AIRFIBR reserves the right to change the service, either for technical reasons or upon the Subscriber’s request. The Subscriber will be notified of any changes to the service that may affect the service features or cost. Any requests to upgrade, downgrade, or change the service must be submitted to AIRFIBR, and the Subscriber will be required to pay any associated charges.
10. Repair and Maintenance
Subscribers are entitled to free repairs for factory defects in the ONU and peripherals. Any damage caused by the Subscriber’s actions, negligence, or force majeure events will be charged to the Subscriber. AIRFIBR will assess and provide the necessary repairs, and the Subscriber will be billed accordingly.
11. Loss or Damage to Equipment
Subscribers will be responsible for the cost of replacing any lost or damaged equipment that is beyond repair. The cost will be included in the next Statement of Account, and the Subscriber will be required to settle this amount promptly. If equipment is damaged due to the Subscriber’s negligence, AIRFIBR may also suspend the service.
12. Suspension/Disconnection
AIRFIBR may suspend or disconnect the service if the Subscriber fails to make payment by the 5th of the month. The service may also be suspended if the Subscriber violates the terms and conditions of this Agreement. In such cases, the Subscriber must settle any outstanding balance before the service will be restored.
13. Termination
Subscribers may terminate the service with one-month written notice and the settlement of all outstanding obligations. If termination occurs with a pending bill, AIRFIBR may reclaim the ONU and peripherals, and the Subscriber will be charged for any unreturned equipment. The Subscriber remains liable for all fees and charges up to the date of termination.
14. Indemnification
Subscribers agree to indemnify AIRFIBR against any claims or damages arising from misuse of the service or illegal activities. This includes any claims related to content transmitted through the service. The Subscriber is solely responsible for the content they transmit and any legal consequences that arise from it.
15. Service Warranty
The service is provided "as is," and AIRFIBR does not guarantee uninterrupted or error-free service. AIRFIBR makes no warranty regarding the quality, accuracy, or validity of the data transmitted through its network. The Subscriber is responsible for ensuring the security and protection of any data sent through the service.
16. Governing Law
This Agreement will be governed by the laws of the jurisdiction in which AIRFIBR operates. Any disputes arising under this Agreement shall be resolved in the courts located in the jurisdiction of AIRFIBR’s operations. The Subscriber agrees to submit to the exclusive jurisdiction of these courts.
17. Miscellaneous
This Agreement constitutes the entire understanding between AIRFIBR and the Subscriber. Any prior agreements, whether oral or written, are superseded by this Agreement. AIRFIBR reserves the right to modify, assign, or transfer its rights and obligations under this Agreement without prior notice.
18. Severability
If any provision of this Agreement is declared invalid or unenforceable by a court of law, the remaining provisions will remain in full force and effect. The Subscriber agrees that the unenforceable provision will be modified to reflect the intent of the original provision to the greatest extent possible.
19. Waiver
Any waiver by AIRFIBR of a breach of any provision of this Agreement does not waive subsequent breaches or affect any other terms of this Agreement. AIRFIBR will not be prejudiced or restricted by any concession, indulgence, or forbearance extended to the Subscriber.
20. Early Termination and Device Handling
If the Subscriber terminates the service within six (6) months from the Service Commencement Date, AIRFIBR reserves the right to reclaim all installed equipment, including but not limited to the Optical Network Unit (ONU), modem, and any peripherals provided during installation. The Subscriber agrees to return the equipment in good working condition upon early termination. Failure to return the equipment or return of damaged items (excluding factory defects) will result in additional charges, which will be reflected in the final Statement of Account.
IMPORTANT: The Subscriber is strictly advised not to reset the modem or ONU to factory settings. Doing so may result in prolonged service disruption, as reactivation and reconfiguration of the device may take a considerable amount of time. Any such action by the Subscriber that leads to service interruption or reconfiguration costs may be billed accordingly.
